Lismar Mencia, Legal Assistant

Lis is a native Venezuelan currently working out of Argentina. Lis assists Attorneys Burns and Jain and the full team with all aspects of litigating personal injury and legal malpractice cases.

Personal Injury and Your Legal Assistant

Our office has been representing victims of personal injury for decades. This requires notifying the responsible party, working with their insurance company and or lawyer, securing photo and video, undertaking appropriate investigation regarding liability, digesting voluminous medical records, and presenting all of the above in a clear and methodical way so that the insurance company, or Court, can understand. This requires significant work…and Lis is there to assist you, and your lawyers, from the outset to the conclusion and resolution of your case.

Motor Vehicle Accidents and Your Legal Assistant

Motor vehicle victims get an extra level of insurance in Massachusetts – no fault PIP, or Personal Injury Protection insurance. This is beneficial but necessitates a careful presentation of medical bills and lost earnings to the insurance company. Lis is there to help protect you, and get you the full benefits of PIP, and Medical Benefits too. Also, in motor vehicle cases with serious injuries, the police are generally involved so working to get police reports and criminal records is often necessary.

Note too that often, to compete, web-based insurance companies will ask folks to “opt out” of PIP which is generally a mistake – it’s inexpensive no-fault insurance that offers good protection.

Legal Malpractice and Your Legal Assistant

Lis works extensively on complex legal malpractice cases. These often involve extensive research into the underlying case, reviewing a multiplicity of documents, summarizing depositions, sorting through prior attorneys’ (often sloppily maintained) files.

Legal malpractice often involves drafting a Massachusetts Consumer Protection Law, Chapter 93A Demand letter. Lis assists with organizing, drafting, and matching the facts to the law in such demands.

Legal malpractice generally involves filing a lawsuit. This necessitates drafting a Complaint, generally reciting the facts, and outlining the various “Counts” of malpractice. Next, legal mal cases need “discovery” so Lis drafts Interrogatories (questions), Requests for Production of Documents, Admissions, and Deposition Notices. Once the discovery documents are served on the other parties, we need to follow up to be sure we get sufficient responses. Lis does this in conjunction with the attorneys. The discovery phase also involved RESPONDING to the discovery of the defendants. This requires that we organize our case into succinct answers, organize the documents and keep meticulous records as to what was produced – and what was “privledged” and what was not requested but may be helpful later on.

Finally, and significantly, legal malpractice cases often involve “motion practice” in which we file, or respond to, important and often dispositive in nature motions. These motions, often called Summary Judgment motions, can be complicated, require affidavits, and citations to documents, laws and court documents. Lis assists with all of this
